This research offers a new and original comparative analysis of direct democracy on human rights and combines cross-national analysis with case studies in four Central-Eastern European Union (EU) countries as Croatia, Romania, Slovakia, and Slovenia.
In doing so, the key element is the dichotomy between referendum rights and human rights (i.e. LGBTI’s or ethnic minority rights referendums) also in connection to European Convention on Human Rights, Charter of Fundamental Rights of the EU, and national Constitutional Courts’ judgments, with the aim to firstly establish the importance of addressing this issue by the European Court of Human Rights and the Court of Justice of the EU. The suggestions for the European Court’s approach towards this issue will be drawn upon the example of the U.S. judicial system, which already has plenty of experience in this area.
